Understanding Georgia Visitation and Custody Laws

The state of Georgia recognizes two main forms of child custody: Physical custody, and legal custody. Physical custody determines where a child will live and how often they will see each parent, whereas legal custody allows the parent or guardian to make significant decisions for their child’s welfare. Typically, both parents will share legal and physical custody, unless there is some salient reason for the judge to make one parent the sole custodian (such as in cases of child abuse.)

Even though it’s considered preferable to award joint physical custody, however, these arrangements can quickly become complicated. For one thing, there may be disagreements about who will be the primary “custodial parent.” Additionally, children over the age of 14 can choose where they want to live. Of course, the judge will always consider the child’s best interests first in determining physical custody solutions – even if that means overriding the child’s preference.

Here are some of the things that your Gerogia parenting plan will need to consider:

  • Where your child will primarily reside throughout the year
  • How you and your ex-spouse will handle important decisions in healthcare, religion, education, and extracurriculars
  • When the child will visit the non-custodial spouse, particularly for holidays breaks, vacations, and other significant events
  • How you will transport your child for mandated visitation
  • What access limitations the non-custodial parent will have, if any
  • How you will handle any emergency situations and parental disagreements
