What is the Georgia Responsible Dog Owner Act?

In 2012, the state of Georgia enacted the Responsible Dog Owner Act. Under this law, dogs who have inflicted harm on a person are considered "dangerous," requiring owners to comply with a set of rules to protect others. A few of these rules are: carrying liability insurance, registering your dog, and having the dog micro-chipped.

If an owner's pet is labeled as "dangerous," the owner must comply with certain rules, including:

  • In the event that the dog must leave the owner's property, the owner must maintain physical control over the dog at all times
  • The dog must be registered as potentially dangerous
  • The owner must carry liability insurance in the amount of $50,000
  • Only one "dangerous dog" may reside on the owner's property at a time
  • Individuals who have been convicted of a felony may not own a "dangerous dog"
  • The dog must be micro-chipped

While this law helps prevent future attacks from happening, dogs who have not yet hurt an individual cannot be classified as a "dangerous dog."

Is the Dog Owner Liable?

In most cases, the owner of the dog is liable for injuries sustained from the bite. As a pet owner, the individual is obligated to ensure that their dog will not bring harm to those around. If the owner fears that the dog may attack another person, it is their responsibility to maintain control of the dog.
